How To Get a Real Estate License In the Philippines Before July 31, 2011


Judging from the interest generated by my recent post on the 3rd batch of PRC approved licenses for Real Estate Brokers (click here) last January 14, 2011 it seems that a lot of friends either wants to know whose licenses were approved by the PRC, or we suspect that their interest was stoked on how to obtain a license themselves.

Well, assuming that you want to get a license as a Real Estate Broker (REB), how will you do it?

First, licensing in the Philippines is now governed by RA 9646 (click here), and only by the Professional Regulation Commission (PRC) (before it was by the DTI).

Second, under the RA 9646, CHED shall implement a course called Bachelor’s Degree in Real Estate Service which shall be required before taking the Board Exams for REBs.

Take heart however, as during this interim period any holder of relevant bachelor’s degree from an educational institution recognized by CHED could take the board exam provided that one has taken 120 credit units of real estate subjects and training from accredited service providers.

What to do then?

Step 1 – Find an accredited service provider, and take the required 120 credit units of CPE, and also have your credentials be checked if you will be qualified to take the exam.

This should be done before March 7, 2011 as the deadline for the filing of application for the REB exam is on that date. The exam itself will be on March 27, 2011 (Sunday) in Manila, Baguio, Cagayan De Oro, Iloilo, and Davao.

Step 2 – Prepare all your documents in advance. Here’s a list of the requirements needed to take the exam:

” Section 14. Qualifications of Applicants for Examinations

In order to be admitted to the licensure examination for real estate service, a candidate at the time of filing his/her application, shall establish to the satisfaction of the Board that he/she possesses the following qualifications:

(A) Citizen of the Philippines,

(B) A holder of relevant bachelor’s degree from a state university or college, or other educational institution duly recognized by CHED: Provided, That he/she has completed at least one hundred twenty (120) credit units of real estate subjects and training from accredited service providers, as may be determined by the Board; Provided, further, That as soon as a course leading to Bachelor’s Degree in Real Estate Service is implemented by the CHED, the Board shall make this course a requirement for taking the licensure examination,

(C) Is of good moral character, must not have been convicted of any crime involving moral turpitude,

(D) An applicant for the licensure examination for real estate consultants must show proof that he/she has at least ten (10) years experience as a licensed estate broker, or an assessor, or as a bank, or institutional appraiser, or an employed person performing real property valuation, or at least five (5) years experience as a licensed real estate appraiser.

All applicants for examination shall be filed with the Board who shall assess and approve said applications and issue to the qualified examinees the corresponding permits or notices of admission to take such examination upon submission of the following documents:

1. Original and photocopy of Birth Certificate or Certificate of Live Birth (NSO) and/or valid Philippine passport, or any other proof of citizenship,

2. Original and photocopy of transcript of records and/or diploma with scanned picture,

3. Original and photocopy of notarized certification by employer of his/her years of experience or pre-requisite Certificate of Registration (COR) and/or Professional Identification Card (PIC) or DTI license (for real estate consultants),

4. Original and photocopy of NBI clearance,

5. Original and photocopy of duly notarized accredited seminar and/or training certificate,

6. Community tax certificate,

7. Four (4) colored passport size pictures with white background and complete nametag and other documents in accordance with the requirements set by the Commission.

Step 3 – Take note of the PRC schedule of the REB exam nearest your place, prepare your documents, apply, and pay the fees. Click here for the link to the PRC website.

From the IRR of RA 9646 (Rule III Section 13), here is the coverage of the exam for REBs:

“For Real Estate Brokers:

1. Fundamentals of property ownership;
2. Code of ethics and responsibilities;
3. Legal requirements for real estate practice;
4. Real estate brokerage practice;
5. Subdivision development;
6. Condominium concept and other types of real estate holdings;
7. Real estate finance and economics;
8. Basic principles of ecology;
9. Urban and rural land use;
10. Planning, development and zoning;
11. Legal aspect of sale, mortgage and lease;
12. Documentation and registration;
13. Real property laws and taxation; and
14. Any other related subjects as may be determined by the Board.

To conform with technological and modern developments, the Board may re-cluster, rearrange, modify, add to or exclude any of the foregoing subjects and their syllabi with tables of specifications as may be necessary.”

This is a golden opportunity for those aspiring to be REB’s. Who knows that after July 31, 2011, the PRC may no longer allow this,  and just wait for the first crop of graduates of the Bachelor’s Degree in Real Estate Service, instead. After all, there are now several thousands of licensed REBs anyway.

From the grapevine within the industry, we heard also that several colleges and universities are now moving fast to integrate this new course into their school course offerings this year.

So to all my friends, who wants to be a real estate broker, consultant, or appraiser – strike while the iron is hot! 🙂

  1. Why is it July 31? Is the March 2011 batch really the last batch they’ll allow to take the exam without the BSRES degree from a CHED-accredited institution? I was surfing the web all day for an answer but can’t seem to find it but had only seen warnings. I initially planned to take the exam but I didn’t know the exam will be this March. Do you think they’ll have another exam for us who qualifies but was unable to take the exam this month?

    • Hi Anne,
      Well I believe it’s up to the new PRB-RES, really. But according to RA 9646 Section 20.5 “…That the real estate practitioners falling under the above-described categories who fail to comply with the necessary CPE requirements within two (2) years after the effectivity of R.A. No. 9646, on or before 30 July 2011, shall be required to take the Board licensure examination for the real estate service practitioners;”. However, the qualification is only as stated in Sec. 14 – with the following statement: “Provided, further, That as soon as a course leading to Bachelor’s Degree in Real Estate Service is implemented by the CHED, the Board shall make this course a requirement for taking the licensure examination…”. So when will it be? When will CHED offer that course – and what is the critical number of schools all over the country offering that course, wherein at that point the PRB-RES will say that the course requirement for taking the Board Exam will now be implemented. It’s really up to them! That’s why in my blog above I qualified my hypothetical statement by saying ” Who knows that after …”. I guess the short answer to your questions then is : Its up to the PRB-RES. I really hope that you can take this exam – even after July 31, 2011 – and pass it so that you can be also licensed as a Real Estate Practitioner. My best wishes, Real Guy.

    • This CEP seminars will eventually be prescribed by the PRB-RES being one of its functions under Section 5.P of the IRR of RA 9646. But it should be in consultation with the AIPO for real estate service practitioners.

      For the meantime, until July 31, 2011, those service providers formerly accredited by DTI is still allowed to give these seminars. Since the coverage of the exam is specified in RA 9646 IRR , Section 13 C, then naturally the CEP should cover the same to prepare the examinee for the exam: ” 1. Fundamentals of property ownership;
      2. Code of ethics and responsibilities;
      3. Legal requirements for real estate practice;
      4. Real estate brokerage practice;
      5. Subdivision development;
      6. Condominium concept and other types of real estate holdings;
      7. Real estate finance and economics;
      8. Basic principles of ecology;
      9. Urban and rural land use;
      10. Planning, development and zoning;
      11. Legal aspect of sale, mortgage and lease;
      12. Documentation and registration;
      13. Real property laws and taxation; and
      14. Any other related subjects as may be determined by the Board.”

    • Sir,

      Since your question does not specify your particular situation, then I will make some assumptions to qualify my answer to your question.

      1) If you are engaged in real estate brokerage without a license then I am duty bound as a license Real Estate Broker to advise you that it is against the law particularly Section 26 of the IRR of RA 9646 – and naturally there are also penalties for doing so. You must get a license before engaging in that type of work.

      2) If you want to be a Real Estate Salesperson, then I must refer you to the latest (August 3, 2011) PRB RES Resolution No. 13 Series of 2011 on how to obtain an accreditation as a Real Estate Salesperson until December 31, 2011 – the details therein of which is self explanatory,

      3) If on the other hand, you are a real estate dealer, then you are exempted from the practice of real estate brokerage under Section 28 of RA 9646, but there are specific taxation laws for Ordinary Assets, as against Capital Assets. The former is subject to creditable witholding tax, while the later to capital gains tax.

      4) If you are a salesperson of a Real Estate Developer, then please refer to Item 2 above.

      P.S : The next schedule of REB Board Exam is published usually at the PRC webpage at http://www.prc.gov.ph. If there’s no more scheduled this year, then maybe there will be next year depending on the PRB RES.

    Good day. May i know when can I start filing my application for accreditation/licensing real estate sales person? One thing more, I got a Brokers exam last march 27 and got the score of 74.75..Is it considered conditional? or is there any special exam for this? Thanks

    • You can apply for accreditation as a Real Estate Salesperson now because it was extended by virtue of PRB Resolution No. 13 Series of 2011. Regarding your score of 74.75 I think you should inquire directly with PRC. As you know the passing score is 75% for all subjects with no score below 50% in any subject (Section 15 of the IRR RESA Law). I have not heard of any conditional or special exam for this – but there’s no harm in sending a letter inquiry.

  6. Hi good day! , Im only high school graduate but Im a real estate sales person in almost 5 years before they announced that we must to have a licensed as a real estate agent..is there a possibilty for me to get a licensed for this bussiness? and how?
    Is there posibilty to have schedule of future seminars, reviews and exams in real estate for november and december 2011. or by the next year?

    • Hi,
      In answer to your query, I suggest that you attend a review for real estate broker from an accredited service provider. (Check their accreditation papers first – and ask around for their reputation as a provider – or better still ask the PRC).

      For the meantime here’s direct quote from the RESA Law (RA 9646) which may answer your question (this is from Section 3):

      ” (1) Real Estate Consultant – a duly registered and licensed natural person who, for a professional fee, compensation or other valuable consideration, offers or renders professional advice and judgment on: (i) the acquisition, enhancement, preservation, utilization or disposition of lands or improvements thereon; and (ii) the conception, planning, management and development of real estate projects;

      (2) Real Estate Appraiser – a duly registered and licensed natural person who, for a professional fee, compensation or other valuable consideration, performs or renders, or offers to perform services in estimating and arriving at an opinion of or acts as an expert on real estate values, such services of which shall be finally rendered by the preparation of the report in acceptable written form;

      (3) Real Estate Assessor – a duly registered and licensed natural person who works in a local government unit and performs appraisal and assessment of real properties, including plants, equipment, and machineries essentially for taxation purposes.

      (4) Real Estate Broker – a duly registered and licensed natural person who, for a professional fee, commission or other valuable consideration acts as an agent of a party in a real estate transaction to offer, advertise, solicit , list, promote, mediate, negotiate or effect the meeting of the minds on the sale, purchase, exchange, mortgage, lease or joint venture, or other similar transactions on real estate or any interest therein;

      (5) Real Estate Salesperson – a duly accredited natural person who performs service for, and in behalf of, a real estate broker who is registered and licensed by the Professional Regulatory Board of Real Estate Service for or in expectation of a share in the commission, professional fee, compensation or other valuable consideration.”

      Maybe the basic principles of ecology, the laws of ecology, Philippines Laws related to environment, EIA, ECC, CLUP, PUD, etc.

      Personally, I don’t totally rely on the review center. I make also my own researches. The internet is a rich source of data. There are also many books on ecology at the bookstore – maybe these can help you.

  8. Do you think the next exam on mar 2012 will almost the same of the examination last mar 2011? I took exam last mar 2011 and my gen ave is 74.75, is that conditional? or i still have to take the whole exam this 2012?

    • Elizabeth,

      No one can tell if the exam on 2012 will be almost the same as in 2011 as it depends on the examiners and PRC. If you attended a review last 2011- then you may be aware that some review centers gives some mock exams that you can use as a basis in your study. My experience however is that not many of the so-called mock review / pointers came out in the exam given. But it also helps!

      Regarding the gen ave of 74.75% – its best to verify it with the PRC as they are the one with authority to answer this question.

      I have many reviewers about ecology – including those that I have during my graduate studies in Environmental Science. I suggest that you enroll with an accredited service provider giving reviews for brokers, appraisers, or consultant.

      I am sure they will have this reviewer since it is required in the examination for brokers – but in my experience, it is even asked for appraisers and consultant’s exam.

    I work full time and I don’t have any experience in real estate.
    Where can I get a notarized certification?
    Is this requirement only for real estate consultants or for all exam applicants?

    • Nat,

      The one you cited is from the IRR of RA 9646 (specifically Resolution NO. 02 Series of 2010 of the PRB-RES) particularly Section 14. That is only applicable for Real Estate Consultants – and specifically for those working as appraisers in banks, or institutional appraisers.

      You see, if you want to apply for examination for Real Estate Consultant – you need 5 years experience as an Appraiser first. If you are not working in the real estate field then you may not be qualified.

      I suggest that you take the exam for a broker or appraiser instead.

  10. Good day sir! Do real estate appraisers and real estate assessors take the same board? I used to work as a real property appraiser for a GOCC and now at the assessor’s office having the same job, the only requirement at the GOCC was to be a licensed CE and at least a graduate of either civil or geodetic engineering at the assessor. Can I apply for a license as Real Estate Appraiser/Assessor without taking the exam having been employed as such for almost 8 years?

    • Hi Mon,

      Yes the examination for assessors would be the same one given to appraisers.

      As to your second question, a person working as an assessor could apply for a license as Real Estate Appraiser under RA 9646. This in the so called “grandfather clause” (I don’t know why this is not called the “grandmother clause” – most probably due to our paternal society? lol!) – wherein brokers, and appraisers previously licensed under DTI could avail of this privilege to be licensed without examination during the period of transition.

      This also include assessors under the following conditions: 1) As of July 30,2009 – holds a permanent position, 2) doing actual appraisal for the last 5 years, 3) passed the RPAO exam by the CSC, 4) undertaken relevant CPE to the satisfaction of the Board (refer to the IRR of RA 9646 Section 20 for the minutia).

      But here’s the caveat: The deadline for filing is already past, i.e. on July 30, 2011 – and obviously since it is now 2012 – it is now too late!

      However, you can take the real estate broker examination which is scheduled on March 18, 2012 (please refer to my blog on https://anythingreal.wordpress.com/2012/01/10/schedule-of-real-estate-service-examinations-for-2012/ for details).

      I strongly recommend that you do especially since you are working at the assessors office, and if you plan to apply for a promotion in the future. Why? You might not yet be aware but the RESA Law (or RA 9646) also has this to say on your future prospects at the assessors office, and I quote:

      “SEC. 30. Positions in Government Requiring the Services of Registered and Licensed Real Estate Service Practitioners

      Within three (3) years from the effectivity of R.A. No 9646, all existing and new positions in the local and national governments, whether career, permanent, temporary or contractual, primarily requiring the services of a real estate service practitioner, shall be filled only by registered and licensed real estate service practitioners. (Note: Assuming that the IRR would be the basis for reckoning, the IRR becomes effective on August 5, 2010 and 3 years after would be August 5, 2013).

      All incumbent assessors holding permanent appointments shall continue to perform their functions without need for reappointment and without diminution of status, rank and salary grade, and shall enjoy security of tenure. However, they may not be promoted to a higher position until they meet the qualification requirements of that higher position as herein prescribed. Nothing in the R.A. No 9646 and the IRR shall be construed to reduce any benefit, interest, or right enjoyed by the incumbents at the time of the enactment of the R.A. No 9646. The appointing authority shall exercise his power to appoint the assessor in accordance with the provisions of R.A. No 9646 and the IRR only when a vacancy occurs.”

        Although I have been holding a permanent position for more than 5 years in the local assessor’s office, I haven’t taken the RPAO exam from the CSC, am not registered with the DTI and, haven’t got at least 120 units of relevant CPE. So yes, I do have to take the exams.

        Problem is, I haven’t got any idea what the exam is about. What is its scope/coverage? The Brokers Exam is scheduled on March 18 and the Appraiser Exam is on July 8, I intend to take the latter.

        After the exam, when applying for a license, are there more requirements or a passing test result will suffice?

    To get an idea about the subjects of the exam for real estate appraisers, you can surf and download it from the internet the “IRR for RA 9646” or the RESA Law – study it, and in there are the specific subjects given for REAs examination (the last part is usually for current events!). I suggest you start looking around for an accredited service provider (accredited meaning those with permission from the PRC to conduct a seminar, and whose certification for the 120 CU will be honored by the PRC later) nearest your place to earn the 120 credit units (usually 6o hrs lecture and 60 hrs field work or actual appraiser reports – commercial, industrial, residential, and machinery).

    If you are living in CDO or Bukidnon or nearby, I can recommend a REASAR to start next week – otherwise you just have to ask around among brokers, or appraisers near your place.

    After passing the exam you have to of course, apply for a license – and pay the P20,000 surety bond as required by RA 9646.

    That’s all there is to it.

    I am a Programmer by profession for 4 years, but I am very much interested in becoming a Real Estate Broker. I plan to take the REB Licensure Exam, thus I stumbled upon your blog.

    • Hi,

      Thank you for your query, and I am glad to be of help.

      First, the particular passage you refer to above is from the IRR of RA 9646 (the RESA Law) in Section 14.D. That is only applicable for Real Estate Consultants (REC) – and not for Real Estate Brokers. As you may already know, a Real Estate Consultant is very different from a Real Estate Broker, or appraiser, or assessor, and of course, a salesperson.

      Second, if you want to take the REB Licensure Exam, the applicable portions of Sec 14 are the following: A, B, and C. The requirements are also specified in the same Section 14 as follows: 1, 2, 4, 5, 6, 7. (Remarks: the item 3 is again for REC’s only – and these experience requirement is as an assessor or appraiser only – not as a programmer).

      Third, I suggest that you must take the CREBSAR (or the Comprehensive Real Estate Broker Seminar and Review) to earn the 120 credit units as mentioned in Sec.14.B from an accredited (by the PRC) service provider.

      Fourth, please ask the service provider (who are supposed to know these things) before taking the plunge – if your course is qualified for taking the REB exam – and if in doubt it may be a good idea to ask the PRC itself – so that you may not be wasting money for the review – but can’t take the exam anyway.

      Fifth, you already have the requisites of a successful real estate broker, and that is your personal interest to do so. That is, in my opinion, already over 50% of your chance for success – the remaining less than 50% would be hard work.

    your blogpost is very informative,, i have been engaged in small-medium scale real estate developing for the past 23 years, however, i have been thinking of putting up my own real estate marketing arm because since this new law has been passed, a lot of my agents, “middle men”, salespersons, went to different brokerages and my sales was greatly affected, so i want to do it myself having the edge of being in the business for many years,, wonder when the next exam will be, i am not in the philippines now, but am going home soon and i want to time it with the review classes and exam dates. do you have any information? also can you give me better inputs about my plans? they would be of great help.     • No school for real estate law specifically. However, you can enroll in the many seminars for real estate brokerage which usually discusses these extensively – and the usual speakers are lawyers.

    • Hi there.

      If you are not a Filipino Citizen then you cannot take the exam. Please check with PRC if it is possible.

      If you are a Filipino citizen, then in my opinion, if your course is a Bachelors Degree then you can qualify – but it is up to the Board to decide. Please verify with PRC.

    • Yes if she meets the requirements.

      Please refer to the RA 9646 for the qualification.

      In order to be admitted to the licensure examination for real estate service, a candidate at the time of filing his/her application, shall establish to the satisfaction of the Board that he/she possesses the following qualifications:

      (A) Citizen of the Philippines,

      (B) A holder of relevant bachelor’s degree from a state university or college, or other educational institution duly recognized by CHED: Provided, That he/she has completed at least one hundred twenty (120) credit units of real estate subjects and training from accredited service providers, as may be determined by the Board; Provided, further, That as soon as a course leading to Bachelor’s Degree in Real Estate Service is implemented by the CHED, the Board shall make this course a requirement for taking the licensure examination,

      (C) Is of good moral character, must not have been convicted of any crime involving moral turpitude,

      (D) An applicant for the licensure examination for real estate consultants must show proof that he/she has at least ten (10) years experience as a licensed estate broker, or an assessor, or as a bank, or institutional appraiser, or an employed person performing real property valuation, or at least five (5) years experience as a licensed real estate appraiser.

      All applicants for examination shall be filed with the Board who shall assess and approve said applications and issue to the qualified examinees the corresponding permits or notices of admission to take such examination upon submission of the following documents:

      1. Original and photocopy of Birth Certificate or Certificate of Live Birth (NSO) and/or valid Philippine passport, or any other proof of citizenship,

      2. Original and photocopy of transcript of records and/or diploma with scanned picture,

      3. Original and photocopy of notarized certification by employer of his/her years of experience or pre-requisite Certificate of Registration (COR) and/or Professional Identification Card (PIC) or DTI license (for real estate consultants),

      4. Original and photocopy of NBI clearance,

      5. Original and photocopy of duly notarized accredited seminar and/or training certificate,

      6. Community tax certificate,

      7. Four (4) colored passport size pictures with white background and complete nametag and other documents in accordance with the requirements set by the Commission.”

  30. Good day sir! I am a degree holder and i work abroad. I really want to have a license for a real estate broker. I dnt know if i am qualified to take the exam. I really want to to leave my work here in abroad and stay for good in my own country …this is the first option that i want but my problem is i dnt have experience in a real estate life. I am 35 years old already …. I need your advise please…

    • Am sorry to say that its too late. You have to go back to school and take BS in Real Estate Management ( a 4 year course) and then take the board exam in the future. Last May 24 is the last chance for those who want to take the Board Exam for Brokers with only a BS course provided they took the 120 hours seminar from a service provider. However, you can still take the board exam for appraisers on August 30 if you go back to the Philippines, enroll in a 120 hours seminar for appraisers and take the board exam on August 30. As for brokers, that window of opportunity is already gone.
